The Promoter is Q1 Resort and Spa trading as Q1 Management and is located at Q1 Resort and Spa, 9 Hamilton Avenue, Surfers Paradise QLD 4217.
The promotional period begins. XXXXXXX closes XXXXXXX.
Entry is open only to all Australian residents and to participants aged 18 (eighteen) years or over.
The directors, management and employees of Q1 Resort and Spa and their immediate relatives (including children, niece, nephew, grandchildren or siblings) are ineligible to enter the competition.

PRIZE: There is one (1) prize to be won. Prize includes a two (2) nights’ stay in a two (2) bedroom ocean view apartment with two (2) adult & two (2) children SkyPoint Observation Deck buffet breakfast tickets. Prize is valid for use between 27/03/20 and 30/06/20. Block out dates: 06/04/20 to 14/04/20. Prize is subject to general inclusions and conditions of entry.
Accommodation is subject to terms and availability. Additional nights will be at an additional charge. Booking number, photo identification and a $200AUD security bond on a Credit Card must be presented on arrival. Accommodation is not redeemable for cash. Any booking extras require payment as per standard booking policy.
Cancellation Policy: Cancellations within 48 hours or no-show results in loss of prize. Please note that check in time is from 2:00pm and check out time is at 10:00am.
The prize winner will be required to provide at least 24 hours notice of intent to redeem.
This competition is a game of chance and skill plays no part in the selection of the winner. The winner will be selected by random draw at Q1 Resort and Spa on. XXXXXXX. The winner will be announced on all Q1 Resort and Spa social media platforms, notified by social media message and phone call on XXXXXXX. The selection of the winner is final and no correspondence will be entered into.
Any component of the prize which is forfeited cannot be exchanged for another prize, transferred or redeemed for cash.
Prizes do not include travel to and from Q1 Resort and Spa, Dream world or Skypoint, spending money or transport and all other ancillary costs is the winners’ responsibility. All Prizes cannot be exchanged or redeemed for cash. In the event a winner does not take the prize at the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash. Any change in the value of the prize between publishing date and the date prize is claimed is not the responsibility of the promoter. Prize is not transferable or redeemable for cash. All components of the prize must be taken at the same time or may be forfeited.
Entrant’s personal details are confidential and will not be provided to other parties.
The promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained relating to the prize except for any liability which cannot be excluded by law.
The promoter accepts no responsibility for late, lost or misdirected entries. Entries must be received by the Promoter during the promotional period.
The promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these conditions of entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under the Lottery and Gaming Regulation 1993 (QLD), and state permit regulation.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to state legislation.
Prize winner must redeem and have stayed before XXXXXXX. Prize not redeemed by XXXXXXX will result in prize being void.
The prize does not include flights or transport to the Q1 Resort & Spa Gold Coast.
Voucher must be presented on arrival. Any booking extras require payment as per standard booking policy. Cancellations within 48 hours of arrival or no-show results in loss of voucher
The Winner must have a valid identity document (ID) to claim the prize, and must provide a Credit Card imprint as part of the apartment’s security bond procedure during check-in to the prize winner’s apartment.
Should the desired dates be unavailable due to lack of availability the winner is to provide new dates until a booking can be confirmed.
Travel insurance is not included and will be for the winners own account.
This prize cannot be sold or transferred to any person other than the winner.
The prize winners will be chosen from a random draw of entries and contacted via email address and or contact number provided on their reservation. winners will be announced within 7 days of the draw date.
The winner will accept the prize as is, at their own risk in the event of unforeseen circumstances, the Promoter reserves the right to substitute the prize with something else of the same value.
The Promoter will adhere to the minimum standards of record keeping as prescribed by the CPA; to the extent allowed in Law, reserve the right to terminate this Competition immediately and without notice; accept no responsibility for any tax commitments arising from the acceptance of a Prize/s and independent financial advise arising from the acceptance of a Prize/s and independent financial advice should be sought for such purpose; not be held responsible for any unforseen costs with regard to the acceptance of a Prize/s besides that which is stipulated in the Competition; to the extent allowed in Law, not guarantee, warrant or make any representations whatsoever regarding the quality of the prize/s.
The participant will indemnify and hold the Promoter harmless in respect of any failure by it to comply with the Terms and Conditions; in the event of the Participant being a Winner, use the Prize/s entirely at its own risk and will indemnify and hold the Promoter harmless for any accident, injury, harm, death, damages, costs and/or Loss sustained by Participant as a result of the possession or use of Prize/s won in the competition; for any loss, damage, harm or injury which the prize winners may sustain as a result of any claim which may be made against it by any third party, whilst participating in this promotional campaign.
The Promoters may refuse to award any prise to a participant if there is suspicion of any irregularities or fraudulent activities.
Neither Promoter nor its agents or distributors will have liability in relation to this promotion.
If the Promoters are required by any legislation, the Minister of Trade and Industry, or the National Lotteries to alter any aspect of the competition or to terminate competition as a result of changes in legislation, the Promoters will have the right to terminate this competition with immediate effect and without notice of such termination. In such event all participants hereby waive any rights which they may have against the Promoters and acknowledge that they will have no recourse or claim of any nature whatsoever against the Promoters, its agents, contractors and/or sponsors.
The Promoter shall not be liable if they are unable to contact the winning phone number within 7 days of being drawn for any reason whatsoever. The Promoter may in its sole discretion decree that the participants whose phone number has been drawn but who is not contactable should forfeit the prize and the Promoter shall then draw a new phone number for the eligible entries.
The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promotion as determined by Promoters in the sole discretion.
At the Promoter’s request, winners will have the option of participating in all the promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name, likeness, images and/or voice in the event they are winner (including photograph, film and/or recording of the same) in Promotional material or in the media for an unlimited period without remuneration for the purpose of promoting this competition (including and outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
The Promoter may with the approval of the winner collect, store and use (not share) personal information of entrants for communication or statistical purposes with the permission of the winner.
The judges’ decision is final, and no correspondence will be entered into.
The Promoter will at its own discretion, be able to amend the rules to the competition at any time during the duration of the competition.
Neither the Promoter nor its agents or distributors will have any liability in relation to this Promotion.
